1. DEFINITIONS

"CONTENT" means all photos, personal information and data, and any other information or data that you submit to SPORTSCREW SORORITY.

"SPORTSCREW SORORITY " or "we" means this website and the SportsCrew Sorority Division of R&S Report Co a Georgia (USA) corporation.

2. WHO MAY PARTICIPATE

You may participate only if you can legally agree to be bound by a contract. No one under 21 years of age may send in a photo or otherwise participate.

3. WEBSITE AVAILABILITY

SPORTSCREW SORORITY may, in its complete discretion, add to, modify, change, or end your use of SPORTSCREW SORORITY. SPORTSCREW SORORITY may be temporarily unavailable due to maintenance and other reasons.

4. ACCURACY OF CONTENT

You must make reasonable efforts to be certain that the CONTENT you submit to SPORTSCREW SORORITY is accurate, complete, and not misleading.

5. INFRINGEMENT

You must obey all copyright laws and other laws covering the CONTENT you submit. You agree not to use SPORTSCREW SORORITY to infringe other people's intellectual property rights, including their copyrights and trademarks. If you believe that a photo displayed on SPORTSCREW SORORITY infringes someone's rights, please notify SPORTSCREW SORORITY using the either the "CONTACT US" link or email photoclub@sportscrew.com.

6. ILLEGAL, UNWANTED OR OFFENSIVE CONTENT

Nobody is permitted to transmit, distribute or post illegal or offensive CONTENT in SPORTSCREW SORORITY , including: (a) profane or sexually explicit advertisements; (b) illegal images; (c) misleading offers; (d) telephone numbers or Universal Resource Locators listed in adult advertising; (e) ads promoting the sales or distribution of firearms, weapons or controlled substances; (f) "get rich quick" schemes, Ponzi or "pyramid" schemes or chain letters; (g) fraudulent or criminal offers; (h) CONTENT created or posted for purposes of harassing other individual(s); (i) "SPAM" or unsolicited e-mail; (k) sexual requests; (l) racial, ethnic or religious epithets, slurs or other similarly derogatory comments; (m) language that advocates violence or hatred or is otherwise offensive to SPORTSCREW SORORITY ; or (n) anything else SPORTSCREW SORORITY , in its complete discretion, considers inconsistent with the tone of its website.

If you are exposed to any of the above, inform SPORTSCREW SORORITY. If SPORTSCREW SORORITY does not cure the problem, you agree that your only remedy will be to avoid SPORTSCREW SORORITY, and that you will not take legal action against SPORTSCREW SORORITY or its owner(s), directors or employees.

7. COPYRIGHT AND PUBLICITY RIGHTS

9. CONTENT OF PHOTOS AND USERS' BEHAVIOR

SPORTSCREW SORORITY may display the photo that you submit but does not control, or assume responsibility for, the content of such photo. SPORTSCREW SORORITY does not assume responsibility for the behavior of anyone who uses SPORTSCREW SORORITY, although SPORTSCREW SORORITY, in its complete discretion, may reject or remove photo(s) it considers inappropriate. SPORTSCREW SORORITY may, in its complete discretion, also reject or remove photo(s) to manage its database.

10. LEGAL REMEDIES

SPORTSCREW SORORITY, in its complete discretion, may pursue any legal remedies it considers appropriate, and may always remove CONTENT, cancel profile(s), and exclude individual(s) from using SPORTSCREW SORORITY.

If SPORTSCREW SORORITY, in its complete discretion, believes that an advertisement is inappropriate or inconsistent with the tone of the website, SPORTSCREW SORORITY may remove such advertisement and exclude the advertiser from SPORTSCREW SORORITY .

SPORTSCREW SORORITY will cooperate with any investigation or other action by any government agency, and is not required to provide notice to you of any such cooperation.

11. DISPUTES BETWEEN OR AMONG USERS

SPORTSCREW SORORITY is under no obligation to become involved in any dispute between or among individuals who use SPORTSCREW SORORITY. In the event you have a dispute with one or more such individuals, you hereby release SPORTSCREW SORORITY and its owner(s), officers, employees, agents, and affiliates from all claims, demands and damages of every kind or nature (actual, direct, consequential or otherwise), known or unknown, suspected or unsuspected, or disclosed or undisclosed, arising out of or in any way related to such dispute or to SPORTSCREW SORORITY.

If you are a California resident, you waive your rights under California Civil Code Section 1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him, must have materially affected his settlement with the debtor."

12. DISCLAIMER OF WARRANTIES

YOU WILL USE SPORTSCREW SORORITY AT YOUR OWN RISK. SPORTSCREW SORORITY PROVIDES SERVICE ON AN "AS IS" AND ON AN "AS AVAILABLE" BASIS. SPORTSCREW SORORITY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

SPORTSCREW SORORITY MAKES NO WARRANTY: (A) THAT SPORTSCREW SORORITY 'S SERVICE WILL MEET YOUR OR ANY OTHER USER'S REQUIREMENTS; (B) THAT SPORTSCREW SORORITY 'S SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF SPORTSCREW SORORITY 'S SERVICE; OR (D) AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION CONTAINED IN OR OBTAINED FROM SPORTSCREW SORORITY .

ANY INFORMATION, MATERIALS, GOODS OR SERVICES YOU OBTAIN USING SPORTSCREW SORORITY ARE OBTAINED AT YOUR OWN RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE RESULTING FROM SUCH INFORMATION, MATERIALS, GOODS, OR SERVICES.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, THAT YOU OBTAIN FROM SPORTSCREW SORORITY SHALL CREATE ANY WARRANTY, UNLESS IT IS IN WRITING AND SIGNED BY A PRINCIPAL OR OFFICER OF SPORTSCREW SORORITY.

13. LIMITATION OF LIABILITY

SPORTSCREW SORORITY AND ITS PRINCIPALS, OFFICERS, DIRECTORS AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY ACTUAL, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES RESULTING FROM ANYONE'S USE OR INABILITY TO USE SPORTSCREW SORORITY , OR FOR THE COST OF PROCURING SUBSTITUTE GOODS OR SERVICES, OR FOR DAMAGES ARISING FROM: (A) ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED USING SPORTSCREW SORORITY ; (B) UNAUTHORIZED ACCESS TO, OR ALTERATION OF, ANY USER'S TRANSMISSIONS, DATA OR CONTENT; OR (C) ANY OTHER MATTER RELATING TO SPORTSCREW SORORITY , INCLUDING DAMAGES INCURRED FROM ANY COMPUTER VIRUS OR OTHER MALICIOUS CODE ENCOUNTERED ON THIS WEBSITE. WAIVED DAMAGES INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, USE, DATA OR OTHER INTANGIBLES, WHETHER OR NOT SPORTSCREW SORORITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FURTHER, SPORTSCREW SORORITY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE, INCLUDING BUT NOT LIMITED TO ACTUAL, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, OR INADVERTENT. SPORTSCREW SORORITY SHALL NOT BE RESPONSIBLE OR LIABLE TO ANY USER OR THIRD PARTY FOR THE STATEMENTS OR CONDUCT OF ANY OTHER USER OR OTHER THIRD PARTY.

IN NO EVENT SHALL SPORTSCREW SORORITY 'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED THE AMOUNT, IF ANY, THAT IS OR WAS PAID BY YOU TO SPORTSCREW SORORITY.

14. NO RESALE OR UNAUTHORIZED COMMERCIAL USE

You agree not to resell or assign your rights under these Terms Of Service. You also agree not to make any unauthorized commercial use of SPORTSCREW SORORITY.

15. INFORMATION / CONTENT OF THIRD PARTY

You agree not to make use of any content or other information that any other user of SPORTSCREW SORORITY or third party has submitted to SPORTSCREW SORORITY.

16. NO AGENCY

There is no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between SPORTSCREW SORORITY and you.

17. NOTICE OF CHANGES; OTHER NOTICES

SPORTSCREW SORORITY may give notice of changes to these Terms Of Service, or of other matters related to SPORTSCREW SORORITY , by displaying such notice in SPORTSCREW SORORITY . Other notice may be given by e-mail.

18. COMPLETE AND EXCLUSIVE AGREEMENT

These Terms Of Service are the complete and exclusive agreement between SPORTSCREW SORORITY and you.

SPORTSCREW SORORITY may - at any time, in its complete discretion and without any prior notice - modify these Terms Of Service in whole or in part.

20. GOVERNING LAW

These Terms Of Service shall be governed by the laws of the State of Georgia , without regard to its conflict of law provisions. You agree that any and all legal claims you may have against SPORTSCREW SORORITY shall be submitted to, and resolved by, binding arbitration in Fulton County , Georgia ( USA ), under the administration and then-current rules of the American Arbitration Association.

21. GENERAL

If SPORTSCREW SORORITY declines to exercise or enforce any right under, or provision of, these Terms Of Service, such forbearance shall not waive any such right or provision.

If an arbitrator or a court of competent jurisdiction finds any provision of these Terms Of Service invalid, such arbitrator or court should nevertheless give effect to SPORTSCREW SORORITY 's intentions as reflected in such provision as best as it may be construed, and all of the other provisions shall remain in full force and effect.

The section titles in these Terms Of Service are for convenience only and have no legal or contractual effect.

R&S Report Company ("SportsCrew", "we" or "us") - which owns and runs SportsCrew Sorority - is committed to safeguarding your privacy online. We take this commitment very seriously. WE WILL NOT SHARE ANY OF YOUR PERSONAL INFORMATION WITH ANY OUTSIDE PARTY UNLESS YOU GIVE US YOUR PERMISSION TO DO SO, OR UNLESS THE LAW (OR OTHER URGENT CIRCUMSTANCES DESCRIBED BELOW) REQUIRE US TO DO SO.

SportsCrew Sorority is made available subject to this Privacy Policy. By using SportsCrew Sorority , you agree - without limitation or qualification - to be bound by this Privacy Policy, so please read it carefully. SportsCrew may update or change this Privacy Policy from time to time, so please check back periodically.

INFORMATION WE COLLECT
If you submit a profile and photo to SportsCrew Sorority, or if you update or change your profile or photo, we collect the following information from you:

Your photo;
Your Name
Your preferred stage name
Your Address
Your physical measurements and decriptors
Your e-mail address;
[IF YOU LIVE IN THE UNITED STATES] Your ZIP code; and
Whether you accept the SportsCrew Sorority Terms Of Service.
We also collect some or all of the following information from SportsCrew Sorority users, including you:

VOTES FOR CONTESTANTS . Every time you view a panel of contestants and vote for your favorite, SportsCrew Sorority automatically updates the contestants' stats (number of contests, number of wins, win percentage, and overall ranking within category). We may collect information on the length of your user session and the number of votes you cast during the session, but we do not track your personal voting preferences, your success at selecting winning contestants, or your voting history.

MESSAGES TO SPORTSCREW SORORITY . Using the "CONTACT US " link on the SportsCrew Sorority home page, you or other users may send us e-mail messages that contain information about you, or about other SportsCrew Sorority users or contestants. We cannot control the type or content of information that may be contained in such messages. Using the "Contact Us" link on the SportsCrew Sorority home page, you or other users may notify us about SportsCrew Sorority photos you believe are unauthorized or inappropriate. We cannot prevent anyone from claiming that a given photo is unauthorized or inappropriate. We may also receive information about you, or about other SportsCrew Sorority users or contestants, through personal correspondence or other forms of communication. We cannot control the type or content of information that may be contained in such communications. Finally, we may receive information from advertisement banners and other items that appear on SportsCrew Sorority and are linked to external websites we do not own or control. We are not responsible for the content or privacy practices of such external websites.

IP ADDRESS / URL INFORMATION / BROWSER INFORMATION . Many websites now collect this type of information. Each time you access SportsCrew Sorority, we collect and store your Internet Protocol (IP) address. As you use SportsCrew Sorority, we track the URL you just came from and the URL you go to next. HOW WE USE INFORMATION WE COLLECT
We use the personal information you provide for the following internal purposes:

Delivering the services you request; Enabling you to access, update, change or delete your profile or photo; Improving website layout, functions, content and service offerings; Analyzing website usage to improve our marketing and promotional efforts; Notifying you of issues, problems or actions taken with respect to your profile or photo;
Announcing offerings and features on SportsCrew Sorority or other SportsCrew websites; and Making your overall SportsCrew Sorority experience as enjoyable as possible. In rare instances, we may also use personal information you have provided to contact you and:

Notify you that you have won, or are eligible to win, a prize in a special SportsCrew Sorority contest or promotion;
Request that you be featured in the SportsCrew Sorority newsletter or in other SportsCrew publication(s) or materials; or
Inform you that an outside party involved in entertainment, media or fashion (such as, for example, a casting, advertising or modeling agency) has expressed a particular interest in your photo and would like to contact you directly. In all of these situations, we will take no further action unless you give us your permission to do so. We will not send you any prize, feature you in any publication or other materials, or share your personal information with any outside party unless you give us permission to do so. In instances where you are to be featured in a newsletter or other publication or materials, you will have a pre-publication right to review all information prepared concerning you, and to refuse the publication of such information if you find it unsuitable for any reason.

We use your IP address to:

Administer SportsCrew Sorority ; Diagnose server problems, if any; and
Assist in handling violations, if any, of the SportsCrew Sorority TERMS OF SERVICE. We use return e-mail addresses to answer the e-mail we receive. We do not use such addresses for any other purpose and do not share them with outside parties.

We analyze the non-identifying aggregate user data we collect and use it to inform sponsors and prospective sponsors as to the number of people who visit SportsCrew Sorority (or who receive the SportsCrew Sorority newsletter) and their demographic characteristics, as well as the number of people who view or click on individual advertisements appearing on SportsCrew Sorority (or in the SportsCrew Sorority newsletter) and their demographic characteristics. The information we provide to sponsors and prospective sponsors is in aggregate form only - we do not disclose any personally identifiable information to sponsors or prospective sponsors as part of this process.

WHEN AND HOW OUTSIDE PARTIES MIGHT USE CERTAIN INFORMATION WE COLLECT
Notwithstanding anything contained elsewhere in this Privacy Policy, there are certain limited instances where outside parties might use certain information we collect:

If a SportsCrew Sorority sponsor and we run a joint contest or promotion on the SportsCrew Sorority website that involves the collection of personal information from SportsCrew Sorority users, we will inform you at the point of collection whether the personal information you are about to provide will be shared with such sponsor or any other outside party. If you do not want us to share your personal information, you can choose not to participate in the contest or promotion.

EXTERNAL WEBSITES LINKED TO SPORTSCREW SORORITY . Advertisement banners and other items appearing on SportsCrew Sorority may be linked to external websites that we do not own or control. Although we hope such websites observe privacy standards as high as ours, we are not responsible for what happens to information you may provide to such websites.

SALE OF SPORTSCREW SORORITY TO AN OUTSIDE PURCHASER . In the event we contemplate selling all or a portion of SportsCrew Sorority to an outside purchaser, such prospective purchaser will likely require access to all information related to SportsCrew Sorority , including the personal information SportsCrew Sorority users have provided to us.
